Terms of service

In short

  • Ahohou is a property management system (PMS): software for bookings, guests, bills and payments.
  • During the pilot there is no charge, and we are still testing the service with you.
  • Your data stays yours. We use it only to provide the service.
  • We never hold your guests’ money. Payments go to your own payment provider.
  • You can stop at any time, and we will help you take your data with you.

1. Who we are and what these terms cover

These terms apply to the Ahohou website (ahohou.com) and to the Ahohou property management system (PMS) (“the Service”). Both are provided by GoSmart Infra Limited, Accra, Ghana (“GoSmart”, “we” or “us”). “You” means the business or person that signs up. By using the Service you accept these terms. If you sign up for a business, you confirm that you have authority to bind it.

2. The pilot

We are running a pilot before general release. During the pilot:

  • there is no subscription charge;
  • features may change, and we may reset test data;
  • until we tell you in writing that your property is live, the Service runs in a test environment. Payments there use your payment provider’s test mode, and no real money moves.

We will tell you in writing before your property goes live and before any charge begins. Either of us may end the pilot with 14 days’ notice.

3. Your account

  • Give us accurate information and keep it up to date.
  • Keep your passwords, PINs and payment provider keys secret. Do not share a login between people.
  • You are responsible for everything your staff do in the Service, and for removing staff who leave.
  • Tell us at admin@ahohou.com straight away if you think someone else has used your account. We may suspend an account to protect its security.

4. Fees, billing and taxes (once your property is live)

  • The prices are those on our pricing page when you subscribe. Hotels and guest houses pay per room each month. Airbnb, short-lets and apartments pay per unit each month. Groups are priced by quote.
  • A one-off setup and training fee applies on a first monthly or quarterly subscription. It is not charged on yearly or longer terms. It is not refundable once setup work has started.
  • Longer terms are paid in advance and carry the discount shown on the pricing page.
  • Prices exclude VAT, sales tax and levies. We add them to your invoice where they apply.
  • We bill in Ghana cedis in Ghana and in US dollars elsewhere.
  • If an invoice is not paid on time, we will tell you and give you a grace period. After that we may limit your account to read-only access until you pay.
  • We may change our prices with at least 30 days’ notice. A change does not affect a term you have already paid for.

5. Your guests’ payments

Guests pay through the payment providers you choose and connect, such as Paystack, Interpay or Stripe, under your own agreement with them. We do not hold, move or settle guest money. We are not a bank, a payment institution or a payment provider. Providers charge their own fees.

We record the payments that your provider reports, so that your bills stay accurate. If we cannot verify a report, we hold it for review and we do not change the bill until it has been checked.

6. Your data and your guests’ data

  • You own the data you put into the Service.
  • For your guests’ personal data, you are the data controller and we are your processor. We use that data only to provide the Service, on your instructions.
  • You are responsible for telling your guests how you use their data, for having a lawful reason to use it, and for following the laws that apply to your property, including registration, tax and data protection laws. Our guest privacy notice helps with this.
  • You can export and erase data in the Service.
  • When your agreement ends, you can export your data for at least 30 days. After that we delete it or make it anonymous, except records we must keep by law.

7. Acceptable use

You must not:

  • use the Service for anything illegal, or to defraud or mislead anyone;
  • try to break into, probe or overload the Service or other customers’ data;
  • upload malware or content you have no right to use;
  • send spam or abusive messages through the Service;
  • copy, resell or reverse engineer the Service, except as the law allows.

If you break these rules, we may suspend or end your access.

8. Security

We protect the Service with reasonable technical and organisational measures, described on our security page. No system is perfectly secure. If a security incident affects your data, we will tell you without undue delay.

9. Availability and support

We aim to keep the Service available, but we cannot promise that it will never be interrupted. We may carry out maintenance, and we will give notice of planned downtime where we can. During the pilot, we provide support by email and WhatsApp on working days.

10. Our intellectual property

We own the Service, its software and the Ahohou name and logo. While your agreement lasts, you may use the Service for your own business. This right is limited, non-exclusive and cannot be transferred. You keep all rights in your own content. You may not use the Ahohou name or logo without our written permission. If you give us feedback, we may use it to improve the Service.

11. Other companies’ services

The Service works with services from other companies, such as Google Cloud, payment providers, smart-lock makers, messaging providers and booking sites. Their own terms apply. We are not responsible for outages or changes that they cause.

12. Limits on our responsibility

During the pilot the Service is provided “as is”. In every case, and as far as the law allows:

  • we are not liable for indirect or consequential loss, or for lost profit, revenue or bookings; and
  • our total liability for any claim is limited to the fees you paid us in the 12 months before the claim.

Nothing in these terms limits any liability that cannot be limited by law, for example for fraud, or for death or personal injury caused by negligence.

13. Ending the agreement

You may stop using the Service at any time. A paid term runs to its end. We may suspend or end your access if you break these terms, do not pay, or put the security of the Service at risk. We will give notice where we can. Sections that are meant to continue after the end of the agreement, such as 6, 10 and 12, will continue.

14. Changes to these terms

We may update these terms. We will publish the new version with its date, and we will email you at least 30 days before a material change takes effect. If you keep using the Service after that date, you accept the new terms.

15. Governing law

These terms are governed by the laws of Ghana, and the courts of Ghana will decide any dispute, unless the law gives you the right to go to court elsewhere. Please contact us first so that we can try to put things right.
